Abdullah Abd Al Mu'in Al Wafti is a citizen of Saudi Arabia who was held in extrajudicial detention in the United States's Guantanamo Bay detention camps, in Cuba.[1] His Guantanamo Internment Serial Number was 262.

Initially the Bush administration asserted that they could withhold all the protections of the Geneva Conventions to captives from the war on terror.[2] This policy was challenged before the Judicial branch. Critics argued that the USA could not evade its obligation to conduct competent tribunals to determine whether captives are, or are not, entitled to the protections of prisoner of war status.
Subsequently the Department of Defense instituted the Combatant Status Review Tribunals. The Tribunals, however, were not authorized to determine whether the captives were lawful combatants -- rather they were merely empowered to make a recommendation as to whether the captive had previously been correctly determined to match the Bush administration's definition of an enemy combatant.
A Summary of Evidence memo was prepared for Abdullah Abd Al Muin Al Wafi's Combatant Status Review Tribunal on 24 August 2004.[3] The memo listed the following allegations:
- a. Detainee is associated with the al-Qaida.
- Detainee traveled from Saudi Arabia to Afghanistan a few weeks after the 11 Sep 01 attacks to work with Al-Wafa.
- The Al- Wafa organization is an organization with close ties to the Taliban and Al-Qaida.
- The detainee was identified as traveling with members of Al-Qaida.
- The detainee's name has been found in computer files listing Al-Qaida members.
Detainees whose Combatant Status Review Tribunal labeled them "enemy combatants" were scheduled for annual Administrative Review Board hearings. These hearings were designed to assess the threat a detainee may pose if released or transferred, and whether there are other factors that warrant his continued detention.[4]
A Summary of Evidence memo was prepared for Abdullah Abd Al Muin Al Wafi's first annual Administrative Review Board on May 18, 2005.[5] The three page memo listed twelve "primary factors favor[ing] continued detention" and two "primary factors favor[ing] release or transfer".
A Summary of Evidence memo was prepared for Abdullah Abd Al Muin Al Wafi's second annual Administrative Review Board on August 1, 2006.[6] The three page memo listed eighteen "primary factors favor[ing] continued detention" and five "primary factors favor[ing] release or transfer".
On November 25, 2008 the Department of Defense published a list of when captives left Guantanamo.[7] According to that list he was repatriated to Saudi custody on November 9, 2007, with thirteen other men. The records published from the captives' annual Administrative Reviews show his repatriation was not the outcome of the formal internal review procedures.[8][9][10] The records show his detention was not reviewed in 2007.
At least ten other men in his release group were not repatriated through the formal review procedure.[8][9][10]
